Terms of Service

The ground rules for joining Buffstack, sharing work, and participating in the community.

Buffstack exists to help independent builders move real work forward. These Terms set the practical boundaries that keep that collaboration useful, lawful, and safe.

Acceptance and eligibility

These Terms of Service ("Terms") form an agreement between you and Buffstack ("Buffstack," "we," "us," or "our"). They apply when you visit buffstack.pro, create an account, or use any Buffstack community feature (collectively, the "Service").

By using the Service, you confirm that you have read and accepted these Terms. If you use Buffstack for an organization, you confirm that you have authority to bind that organization. If you do not accept these Terms, do not use the Service.

You must be at least 18 years old and legally able to enter into this agreement. The Service is not directed to children.

Accounts and access

You must provide accurate information, keep it reasonably current, and maintain the security of your sign-in method. You are responsible for activity performed through your account unless you promptly tell us that it has been compromised.

One person should not operate multiple accounts to mislead other members, manipulate activity, evade restrictions, or impersonate another person or organization.

  • Do not share authentication links, passwords, or access tokens with anyone who should not control your account.
  • Tell us promptly at lucas@buffstack.pro if you believe your account or content has been accessed without authorization.
  • We may require additional verification before restoring access or acting on a sensitive account request.

Community conduct

Buffstack is a working community for independent builders. You may discuss ideas, share work, ask for feedback, and collaborate, but you must use the Service lawfully and in a way that respects other members.

  • Do not harass, threaten, stalk, exploit, or discriminate against another person.
  • Do not publish unlawful, defamatory, deceptive, sexually exploitative, or privacy-invasive material.
  • Do not spam, run unauthorized promotions, artificially manipulate engagement, or scrape member data.
  • Do not upload malware, probe for vulnerabilities, bypass access controls, disrupt the Service, or use automated systems that place an unreasonable load on it.
  • Do not infringe intellectual-property, publicity, confidentiality, or other rights.
  • Do not use information from Buffstack to train, enrich, or sell a member database without the affected members' permission.

We may investigate reports and remove, restrict, or preserve content when reasonably necessary to enforce these Terms, protect the community, or comply with law. Context matters, and enforcement decisions may account for severity, history, and risk.

Your content

You retain ownership of the posts, comments, profile information, messages, files, links, feedback, and other material you submit to the Service ("Member Content"). You are responsible for Member Content and must have the rights needed to share it.

You grant Buffstack a non-exclusive, worldwide, royalty-free license to host, store, reproduce, process, transmit, and display Member Content only as needed to operate, improve, secure, and provide the Service according to your chosen audience and settings. This license ends when the content is deleted from our active systems, except where continued retention is reasonably required for backups, safety, dispute resolution, legal compliance, or content you shared with others that they continue to possess.

Direct messages are intended for their participants. We do not use private messages in public marketing without permission, though authorized systems, service providers, or personnel may process them when necessary to deliver the feature, investigate abuse, protect the Service, or comply with law.

Privacy

Our Privacy Policy explains what personal data we collect, why we use it, how we share it, and the choices available to you. It is part of these Terms by reference.

Remember that profile information and community contributions may be visible to other members or, where a feature is public, to anyone on the internet. Choose what you share accordingly.

Service changes and availability

Buffstack is an evolving service. We may add, modify, pause, or discontinue features; set technical limits; or change which features are free. When a change materially reduces a core feature, we will provide reasonable notice when practical.

We work to keep the Service available, but we do not promise uninterrupted or error-free operation. Maintenance, security events, provider outages, or circumstances outside our control may affect access.

Third-party services and links

The Service relies on third-party infrastructure and may contain links, embeds, integrations, or offers provided by others. Third parties may apply their own terms and privacy practices. Buffstack does not control and is not responsible for third-party content, products, availability, or practices.

References to tools, member projects, resources, or partner offers do not guarantee their quality, safety, continued availability, or suitability for your needs. Evaluate them independently before relying on or purchasing them.

Buffstack property

The Service, including its software, visual identity, layout, original editorial material, and other content supplied by Buffstack, is owned by Buffstack or its licensors and is protected by applicable law. These Terms do not transfer ownership of that material to you.

Subject to these Terms, we give you a limited, personal, non-exclusive, non-transferable, revocable right to use the Service for its intended purpose. You may not copy, resell, reverse engineer, or create derivative products from protected parts of the Service except where applicable law expressly allows it.

Product feedback

If you send suggestions or product feedback, you give Buffstack permission to use, adapt, and incorporate that feedback without restriction or payment. This does not transfer ownership of your separate Member Content, private business information, or pre-existing intellectual property.

Suspension and termination

You may stop using Buffstack at any time and can deactivate your account from Settings. Deactivation restricts account access but is not necessarily the same as deleting every associated record. Contact us if you want to request deletion.

We may restrict, suspend, or terminate access if we reasonably believe you violated these Terms, created risk or legal exposure, harmed the community, or if continued access is not operationally feasible. We will provide notice and an opportunity to address the issue when reasonable, but may act immediately to prevent harm.

Provisions that by their nature should continue after termination—including ownership, licenses required for retained records, disclaimers, liability limits, and dispute terms—will survive.

Disclaimers

To the maximum extent permitted by law, the Service is provided "as is" and "as available." Buffstack disclaims implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

Community posts, comments, messages, resources, metrics, and recommendations are created by members or third parties. They are not professional, legal, financial, tax, medical, or investment advice from Buffstack. You remain responsible for your decisions, projects, backups, and interactions with other members.

Nothing in these Terms excludes a warranty, right, or remedy that cannot lawfully be excluded, including applicable consumer rights.

Limits of liability

To the maximum extent permitted by law, Buffstack and its operator, contributors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages; lost profits, revenue, data, goodwill, or opportunities; or losses resulting from member conduct, third-party services, or unauthorized access.

To the maximum extent permitted by law, Buffstack's total liability arising out of or relating to the Service or these Terms will not exceed the greater of the amount you paid Buffstack for the Service during the 12 months before the event giving rise to the claim or USD $100.

These limits apply regardless of the legal theory and even if a remedy fails of its essential purpose, but they do not apply where liability cannot be limited under applicable law.

Your responsibility for claims

To the extent permitted by law, you agree to defend, indemnify, and hold harmless Buffstack and its operator from third-party claims, damages, and reasonable costs arising from your Member Content, your unlawful use of the Service, or your material breach of these Terms. This obligation does not apply to the extent a claim results from Buffstack's own conduct.

Governing law and disputes

These Terms are governed by the laws of the Federative Republic of Brazil, without regard to conflict-of-law rules. Before filing a formal claim, you and Buffstack agree to make a good-faith effort to resolve the issue by email for at least 30 days.

Any dispute that cannot be resolved informally will be submitted to courts with jurisdiction under applicable law. Nothing here prevents either party from seeking urgent relief or using a small-claims or consumer forum where available, and mandatory consumer protections in your place of residence continue to apply.

Changes to these Terms

We may update these Terms as the Service or law changes. We will post the revised version here and update the date above. If a change materially affects your rights, we will provide additional notice through the Service or by email when reasonable.

Your continued use after revised Terms take effect means you accept them. If you do not agree, you must stop using the Service.
